DayBright Terms of Use
1. Who you are agreeing with
These terms are an agreement between you and Sergey Dikarev, the independent developer of DayBright, operating as wilder.dev ("I", "me"). Apple is not a party to these terms, except as set out in section 13. By downloading or using DayBright you accept these terms; if you do not accept them, do not use the app.
DayBright is distributed through Apple's App Store. These terms include the terms that Apple requires (section 13) and take precedence over Apple's standard Licensed Application End User License Agreement where the two differ. The DayBright Privacy Policy, available at the same place as these terms, explains what the app does with your data and is part of these terms.
2. Using DayBright
I grant you a personal, non-commercial, non-transferable, non-exclusive and revocable licence to install and use DayBright on Apple devices that you own or control, as permitted by the Usage Rules in Apple's App Store terms, including through Family Sharing. The licence does not include the right to copy, modify, distribute, sell, rent or sublicense the app, to reverse engineer or decompile it, or to extract its built-in content, except where the law allows it regardless of this clause.
You must be at least 13 years old, or the minimum age for an Apple Account in your country if that is higher. If you are under 18, a parent or guardian must agree to these terms on your behalf and must approve any purchase.
DayBright requires iOS 27 or later. Generated sparks require a device with Apple Intelligence turned on and a supported language; without it, DayBright uses its built-in library of sparks.
3. What DayBright is, and is not
DayBright is a daily wellbeing and habit companion. Every day it writes a short brief and one small action (a spark) for an area of life you care about, and turns your evening check-in into a reflection and a weekly review. The text is produced by an artificial-intelligence model running on your device, or taken from a built-in library.
Generated text can be wrong, repetitive, odd or unsuitable for your situation. Read every spark with your own judgement before acting on it. Nothing DayBright shows is medical, mental-health, nutritional, fitness, financial, legal or other professional advice, and it does not replace a doctor, therapist or other professional. If a spark involves physical activity, make sure it is safe for you. If you are in distress or in danger, contact your local emergency services or a crisis line; DayBright does not monitor your data for emergencies and cannot respond to them. You are responsible for what you choose to do.
4. DayBright+ subscription
Free DayBright includes the daily brief and spark, swapping or easing a spark, the evening check-in, the Journey screen, widgets, Control Center buttons, Siri and Shortcuts, reminders and share cards, with up to three active areas from the built-in set.
DayBright+ adds unlimited active areas and custom areas, personal context from Calendar, Weather, Health, Reminders and Contacts, the "Your spark fits now" notification, writing to Health, and sparks from a photo. I may add, change or remove features of either tier over time. If I remove a DayBright+ feature during a period you have paid for, you may cancel; any refund is handled by Apple as described below.
DayBright+ is an auto-renewable subscription with a monthly and a yearly plan:
- Prices are shown in the App Store in your local currency before you buy and may differ between countries. Taxes may apply.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the current period ends.
- You can manage or cancel the subscription at any time in your Apple Account settings (iOS Settings, your name, Subscriptions). Cancelling stops future renewals; you keep DayBright+ until the end of the period you have paid for.
- Apple is the seller of record for in-app purchases. Refunds, including for an unused part of a period, are decided by Apple under its policies and the law in your country; request one at reportaproblem.apple.com. I cannot issue refunds myself.
- If the price changes, Apple informs you in advance and, where the law or Apple requires it, asks for your agreement before the new price applies. If you do not agree, cancel before the renewal.
- Family Sharing is supported: an active DayBright+ subscription can be shared with your Family Sharing group.
- To use DayBright+ on a new device, sign in with the same Apple Account and tap Restore purchases in DayBright's Settings.
- Subscriptions to DayBright Premium bought in earlier versions continue as DayBright+.
- If a free trial or an introductory offer is available, its terms are shown in the App Store before you accept it, and the subscription renews at the regular price when the offer ends unless you cancel beforehand.
5. Your content
The notes you write, the custom areas and art you create, the photos you choose and the moments you add stay on your device and remain yours. I never receive them, so I need no licence to them. You are responsible for what you create, and it must not be unlawful or infringe anyone's rights.
You may use the briefs, sparks, reflections, reviews and share cards that DayBright produces for you for any personal purpose, including sharing them. You are responsible for anything you share and for where you share it.
6. My content and intellectual property
DayBright, its design, illustrations, built-in library of sparks, text and names (DayBright, DayBright+, Spark, Glow, Journey) are owned by me or licensed to me and are protected by copyright and trademark law. These terms give you no right to them beyond the licence in section 2. Apple, Apple Intelligence, Siri, Health, iPhone and iPad are trademarks of Apple Inc. Open-source components used by DayBright are listed in the app or in the App Store description and are governed by their own licences.
7. Acceptable use
Do not use DayBright in a way that breaks the law; interfere with its operation; bypass or try to bypass purchase checks or feature limits; remove or alter any copyright or trademark notice; or use automated means to extract content from it.
8. Apple services
DayBright relies on Apple services that are provided, and may be changed or withdrawn, by Apple under Apple's own terms: Apple Intelligence (whose availability depends on your device, region, language and settings), Apple Weather (weather data may be unavailable, delayed or inaccurate; see https://weatherkit.apple.com/legal-attribution.html), Health, Calendar, Reminders, Contacts, Photos, Siri and Shortcuts, Journaling Suggestions, widgets and Live Activities. I am not responsible for the availability, accuracy or behaviour of these services.
9. Changes, updates and availability
I may update, change, suspend or discontinue DayBright or any of its features at any time, and I may stop supporting older versions of iOS. Some changes may require you to install an update. I do not promise that DayBright will always be available or free of errors.
10. No warranty
DayBright is provided "as is" and "as available". To the fullest extent permitted by law, I make no warranty or promise about DayBright, including about its accuracy, fitness for a particular purpose, availability or freedom from errors. Nothing in this section limits the consumer rights you have under the law of your country, for example the statutory guarantees in the European Union, the United Kingdom or Australia.
11. Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profit or goodwill, arising from DayBright or these terms, and my total liability to you for all claims together is limited to the amount you paid for DayBright+ in the twelve months before the claim arose. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited by law.
12. Ending the agreement
You can end this agreement at any time by deleting DayBright from your devices; an active subscription continues until you cancel it in your Apple Account settings. I may end your licence if you breach these terms in a serious way. Sections 5, 6, 10, 11, 13, 14 and 15 continue to apply after the agreement ends.
13. Terms required by Apple
- Acknowledgement: these terms are between you and me, not Apple. I, not Apple, am solely responsible for DayBright and its content.
- Scope of licence: the licence in section 2 is limited to a non-transferable licence to use DayBright on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that DayBright may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support: I am solely responsible for providing any maintenance and support for DayBright. Apple has no obligation to furnish any maintenance or support services for it.
- Warranty: I am solely responsible for any product warranties, whether express or implied by law, to the extent not disclaimed in these terms. If DayBright fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for DayBright to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to DayBright, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are my sole responsibility.
- Product claims: I, not Apple, am responsible for addressing any claims by you or any third party relating to DayBright or your possession or use of it, including product liability claims, claims that DayBright fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation, including in connection with DayBright's use of the HealthKit framework.
- Intellectual property rights: if a third party claims that DayBright or your possession and use of it infringes that third party's intellectual property rights, I, not Apple, am solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance: you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address: Sergey Dikarev (wilder.dev), me@wilder.dev. Direct any questions, complaints or claims about DayBright there.
- Third-party terms: you must comply with any applicable third-party terms when using DayBright, including Apple's terms for the Apple services listed in section 8.
- Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
14. Governing law and disputes
These terms are governed by the laws of the United States of America, without regard to its conflict-of-law rules, and the courts of the United States of America have jurisdiction over any dispute arising from them. If you are a consumer in the European Union, the United Kingdom or another place whose law gives you mandatory protections, you keep those protections and may bring a claim in the courts of the country where you live. Before any formal step, please write to me@wilder.dev; most problems can be solved in an email or two.
15. Other terms
These terms and the Privacy Policy are the entire agreement between you and me about DayBright. If a part of these terms is found invalid, the rest stays in force. If I do not enforce a term, I do not waive it. You may not transfer this agreement; I may transfer it to someone who takes over DayBright, and I will tell you if that happens. These terms are written in English; a translation is for convenience only and the English version governs.
16. Changes to these terms
When these terms change, the new version is posted at the same link with a new date, and a material change is mentioned in the app's release notes or in the app. Continuing to use DayBright after a change means you accept the new terms; if you do not, stop using DayBright and cancel any subscription.
